Team Total Grants 2016 – 2017 Terms and Conditions

ARTICLE 1: ORGANIZING COMPANY

TOTAL S.A., a limited liability company with registered capital of €6 257 823.50  with its registered office at 2 place Jean Millier, La Défense 6, 92400 Courbevoie, France, registered under the number 542 051 180 on the Trade and Companies register of Nanterre (hereinafter the “Organizing Company”), is organizing from September 5, 2016, 11:59 a.m. Central European Time (CET) until January 30, 2017 at 11:59 a.m. (CET) a competition entitled “Team Total Grants” (hereinafter “the Competition”) which is free of charge with no purchase obligation.

ARTICLE 2: CONDITIONS OF ENTRY

2.1 The Competition is open to all adult students over the age of legal majority in accordance with their country legislation and validly registered as students at the date of the Competition opening and studying a Bachelors, Masters or PhD-level qualification, or the local equivalent, at a recognised degree awarding institution, such as a University, Grande École, College or Fachhochschule, on a full-time or part-time basis (hereinafter “Participant(s)”).

2.2 This Competition (including its updates) may be accessed on the website with the following web address: www.total-campus.com (“Website”)

2.3 The Competition will enable selection of student associations and professional associations student chapters’ projects (hereinafter “the Team”) for various categories of Grants:

  • Push Your Limits – funding to participate in a sporting competition, adventure challenge or cultural event
  • Innovate – funding for student organizations with a passion for innovation and sustainable energy who want to bring a new idea to life in these domains
  • Outreach – funding for projects which aim to improve living standards in your community or overseas
  • Dream Ticket – funding for geosciences and petroleum engineering student associations to undertake study trips, international conferences participation or professional development activities

2.4 Employees of the Organizing Company, Organizing Company’s associated companies, Organizing Company’s agencies associated with the Competition and their immediate families are ineligible to participate to the Competition.

2.5 Throughout the Competition, only one entry per Participant per category (same name, postal address and e-mail address) is permitted.

Each establishment may submit more than one entry form through its different associations and more than one Grant can be awarded per establishment. The status of winner is subject to the validity of the entry of students who are members of the same Team.

A Participant cannot be a member of more than one Team and therefore cannot submit more than one application per each category.

Should a Participant use different addresses or different identification details, this shall be deemed to be attempted fraud entailing permanent disqualification of the Participant.

2.6 The Organizing Company reserves the right to perform any necessary checks relating to Participants’ identity, age, postal address and e-mail address.

Any registration based on false, inaccurate, incomplete or fraudulent information shall not be considered and shall invalidate the entry.

ARTICLE 3: TERMS AND CONDITIONS OF ENTRY/COMPETITION PROCEDURE

3.1 The Competition will be announced in colleges and universities, on the Total Campus website and social media and via the Total Campus newsletter subscribers whose e-mail addresses are in the Organizing Company’s possession.

3.2 Electronic entries on the Website www.total-campus.com are the only means of entering the Competition. It is possible to log in to the Website using a computer that is connected to the Internet. Since connection is free-of-charge in colleges and universities, no reimbursements shall be granted.

3.3 The Competition will be organized as follows:

Opening date of the Competition: September 5, 2016 (11:59 a.m. Central European Time – CET)

Closing date of the competition: December 5, 2016 (5:00 pm CET)

Opening date of public voting: December 23, 2016 (11:59 a.m. CET)

Closing date of public voting: January 23, 2017 (11:59 a.m. CET)

Dates are subject to be changed by the Organizing Company and in case of changes these will be announced on Total Campus website: www.total-campus.com.

3.4 In order to enter the Competition, each Team Leader must, between September 5, 2016, 11:59 a.m. CET and December 5, 2016, 5:00 pm CET take the following steps:

  • go to the Website
  • create an application by entering the requested information (choose the grant, personal information regarding entrants, details about the project, motivation)
  • supply additional documents to support the application.

3.5 Teams must complete all input fields marked as compulsory. Any entry that includes missing, false, incomplete or illegible information or that is submitted after the deadline date and time for entries shall be deemed invalid and shall not be considered. If any Team member forgets to include any of the required information in the registration application, a message will prompt him/her to complete the omitted information.

3.6 The Team leader will be sent, no later than two (2) hours after validation of his/her Team’s registration form, an e-mail confirming this Team’s entry in the Competition.

3.7 The fact that a student has entered the Competition shall under no circumstances oblige the Organizing Company to take any further steps entailing recruitment of the student within the company or the offer of an internship, international coop placement (V.I.E/V.I.S.) or apprenticeship.

ARTICLE 4: NOMINATION OF WINNERS AND ENDOWMENTS AT STAKE

4.1 On December 23, 2016 for the Dream Ticket category and January 30, 2017 for the other categories, the Organizing Company shall nominate winners from the Teams that have complied with the terms and conditions of entry provided by these rules.

4.2 The total endowment granted by the Organizing Company for the four (4) grant categories shall be maximum €81,000 as follows:

–  €41,000 is awarded to Dream Ticket Grants, limited to a maximum of 10 grants. The number of Dream Tickets and the funding per team will be decided by a Total committee, according to the criteria defined in the current rules.

–  €40,000 is awarded and split between the other 3 grants:  the Push Your Limits, Innovate and the Outreach grants. At least one grant will be allocated per category.  The total funding for each of the Push Your Limits, Innovate and the Outreach grant categories will be decided by a Total committee, according to the criteria defined in the current rules.

This endowment shall be split between the winners of the various grants based on the needs of each project. Prizes shall be defined based on the selected projects and may cover all or part of the necessary costs for running them.

A letter of commitment shall furthermore be signed by each winning Team and the Organizing Company determining the financial consideration associated with the prizes.

Additional details concerning Competition prizes for certain grants:

  • Push Your Limits: A letter of commitment will be signed by the winning Teams and the Organizing Company. A mission report will be requested after each sporting competition, adventure challenge or cultural event.
  • Innovate: A letter of commitment will be signed by the winning Teams and the Organizing Company. This stipulates that team leaders of selected projects must perform presentations before and after tangible outcomes in the field. A mission report will be requested as well as a report after a year’s operations.
  • Outreach: A letter of commitment will be signed by the winning Teams and the Organizing Company. This stipulates that team leaders of selected projects must perform presentations before and after tangible outcomes in the field. A mission report will be requested as well as a report after a year’s operations.
  • Dream Ticket: A letter of commitment will be signed by the winning Teams and the Organizing Company. The winners agree to include ‘Sponsoring by Total’ and the Total company logo on documents and “student chapters” websites and associations, in compliance with the Corporate Graphic charter. A detailed mission report, including photos will be supplied to Total at the end of the project or trip.

The endowment does not include additional expenses including (but not limited to) costs arising from transport to the start or finish, meals, telephone calls, faxing and internet use, travel insurance, taxes, local airport taxes, upgrades, purchases and other personal expenses, which shall be borne entirely and solely by the winners.

The Organizing Company reserves the right to replace the endowments with endowments of an equivalent value if circumstances dictate.

ARTICLE 5: NOTIFICATION OF WINNERS AND ALLOCATION OF ENDOWMENTS

5.1 Results and responses to the Competition will be published on the Website from: 11:59 a.m. CET on December 23, 2016 for the Dream Ticket category and 11:59 a.m. CET on January 30, 2017 for the Push Your Limits, Innovate, and Outreach grant categories.

5.2 Winners will be notified by e-mail to the e-mail address specified in their entry application within two (2) full days of closure of the Competition.

To receive their endowments, winners must reply by e-mail to the Organizing Company confirming their acceptance of their endowment no later than seven (7) days after the Organizing Company has sent the e-mail informing them of the Competition results and they must confirm their personal details (surname, first name, date of birth, address and e-mail address).

5.3 Endowments cannot be exchanged for other endowments, for their monetary value or for a currency of any kind and on any grounds whatsoever.

Endowments are not transferable to third parties; only the winning Team may benefit from them personally.

5.4 The Organizing Company reserves the right not to grant an endowment to a winner if it emerges that the winner has cheated or failed to comply with the terms and conditions of these rules.

ARTICLE 6: SELECTING WINNERS

6.1 Making an Application

For each of the grants, the application process will be made on line via the Website, starting from the opening of the competition on 5 September at 11:59 CET.

Winning applications from previous years will not be reassessed.

6.2 For Push Your Limits, Innovate, and Outreach Grants

6.2.1 Shortlisting

On December 23, 2016 the Organizing Company shall nominate between six and nine teams as shortlist for the three grant categories that have complied with the terms and conditions of entry provided by these rules.

The shortlist of the teams will be selected by a selection committee consisting of Organizing Company employees. The selection committee criteria will be:

  • Team motivation and effort with respect to the project (role of each participant, motivation etc)
  • The existence of a provisional planning calendar for the project’s realisation
  • The communication plan for the project within the school institution and with respect to students in general.
  • Sharing of Organizing Company values: innovation, team spirit, solidarity, challenging and exceeding oneself, in the presentation and explanation of the project
  • Originality of the media presented.

Specific criteria:

  • For Push Your Limits, the entrants’ sporting abilities or proven talent in cultural or artistic activities.
  • For Innovate and Outreach: full technical application (scientific method, figures, material costs, etc.), environmental and social relevance of the project; steps taken to ensure that it continues to be effective in the long-term. There will be a focus on knowledge transfer and local stakeholder training (energy issues, maintenance, etc).

The shortlist will be displayed on the Organizing Company website www.total-campus.com for a public voting according to the period listed in Article 3, from 23 December 2016 at 11:59 (CET).

6.2.2 Online public voting

During the voting period, any visitor to the Website will be allowed to vote for one or more Teams shortlisted.

Voters can only vote for individual shortlisted entries once. However, they can vote for more than one entry.

In order to vote for an entry, the Website visitor will be asked to supply his/her email address. He/she will automatically receive a unique voting token for the selected entry.

In order for the vote to be processed, the Website visitor will have to click on the voting token received and thus validate his/her email address. This process will be repeated for additional votes for additional entries.

Votes generated by a robotic, programmed, script, macro or other automated means may lead to disqualification of the team concerned. The Organizing Company reserves the right to disqualify any of the Participants for any actions or any suspected actions by him/her, or by the supporters, which are intended to unfairly impact the voting mechanism, or any actions that are intended to distort the voting mechanism, whether direct or indirect.Temporary and anonymous emails will be considered invalid (notably those originating from youumail.com; youpymail.com; yopmail.com; brefmail.com; mailcatch.com; yopmail.fr; yopmail.net; cool.fr.nf; jetable.fr.nf; nospam.ze.tc; nomail.xl.cx; mega.zik.dj; speed.1s.fr; courriel.fr.nf; moncourrier.fr.nf; monemail.fr.nf; monmail.fr.nf…), as well as those email addresses created solely for the purpose of voting.The number of votes received is not the only criteria for selection as winner, but will be taken into account by the jury.

6.2.3 Selecting Winners

A selection committee consisting of Organizing Company employees will review the shortlisted entries based on criteria listed at article 6.2.1 and taking into account the online voting results. The winning teams will be announced on January 30, 2017, from 11:59 CET, on the Organizing Company website.

All individual members of shortlisted teams will receive a Total goody bag to a value of maximum €100 as consolation prizes.

6.3. For Dream Ticket Grants

6.3.1 Selecting Winners

Entries will be subject to selection based on selection committee rankings comprised of Organizing Company employees.

The selection committee can retain up to ten different projects.

The selection committee criteria will be:

  • Team motivation and effort with respect to the project (role of participants, motivation, number of students, etc).
  • The contribution of technical and/or professional knowledge of the oil industry demonstrated by the project.
  • The total cost.

The winners’ selection will be announced on December 23, 2016, from 11:59 CET on the Organizing Company website.

In addition, public voting will take place according to the period listed in Article 3, from 23 December 2016 at 11:59 (CET), in order to award a special prize consisting of a photo camera to a value of maximum €500 given to the Dream Ticket winning student association or student chapter that proposed the project and which gets the most public votes. The winner will be announced on 30 January 2017.

6.3.2 Public vote for the Special Prize

During the voting period, any visitor to the Website will be allowed to vote for one or more Teams shortlisted.

All winning Teams undertake to pay any taxes, duties, social security contributions or any other levies of any kind whatsoever that are payable pursuant to the applicable regulations. The Organizing Company shall be released from any liability in that regard.

6.5. Members of winning Teams can only be replaced in the event of force majeure and by a student from the same college.

6.6. All winning Teams undertake to refrain from entering into other partnerships within the energy or energy derivatives sector (e.g. a lubricant brand).

ARTICLE 7: AGREEMENT REGARDING EVIDENCE

7.1. It is agreed that, except in clear instances of error, the Organizing Company may rely upon, notably for the purposes of proving any act, deed or omission, any programs, data, files, records, operations and other items (such as monitoring reports or other statements) of an IT or electronic nature, format or medium, which are created, received or stored directly or indirectly by Organizing Company, notably in its information systems.

These items shall therefore constitute evidence used for such purposes as justifying the ranking of Teams during selection.

7.2. The Teams undertake to refrain from contesting the admissibility, validity or evidential force of the aforementioned items of an IT or electronic nature, format or medium, on the basis of any legal provision whatsoever that may specify that certain documents must be written or signed by the parties in order to constitute evidence.

The considered items therefore constitute evidence and, if they are produced as evidence by the Organizing Company in any proceedings, contentious or otherwise, they shall be admissible, valid and enforceable between the parties in the same way, under the same conditions and with the same evidential force as any written document that may be drawn up, received or stored.

ARTICLE 8: PERSONAL DATA

8.1 Purposes of processing

Personal data shall be processed within the scope of the Competition for the purposes of managing the Competition, determining the winner(s) and allocating and transferring endowments.

With Participants’ express consent signalled by them ticking the check box “I agree to receive e-mails from contact@total-campus.info” on the Competition application form, their personal data may also be used by the Organizing Company for the purposes of market research.

Personal data shall be collected and processed by the Organizing Company in accordance with the French Data Protection Act of 6 January 1978 (Act 78-17 on Information Technology, Data Files and Civil Liberties) and these operations have been declared to the French Data Protection Commission (CNIL), reference number 1698677.

8.2 Data recipients

The Organizing Company is the recipient of any personal data collected and these data may be forwarded to its partners for the purpose of market research subject to the express consent of each Participant signalled by them ticking the check box “I agree to receive e-mails from contact@total-campus.info” on the Competition application form.

Any personal data collected may be passed on to service providers and subcontractors in order for them to perform services on behalf of the Organizing Company in connection with this Competition.

The Organizing Company may also forward Participants’ personal data in the event of it receiving requests from a judicial authority or any legally authorized administrative authority requesting this data in accordance with the legislative provisions in force.

8.3 Data security and confidentiality

The Organizing Company shall take appropriate steps to protect the security and confidentiality of Participants’ personal data and, notably, prevent them from being altered, damaged or shared with a third party without permission.

8.4 Data storage period

Participants’ personal data shall be stored for as long as is required for processing. This period shall not exceed three (3) years. They shall be stored in accordance with the personal data protection legislation in force.

8.5 Transfer of your data outside the European Union

The Organizing Company is unlikely to transfer Participants’ personal data to other countries except when responding to Participant s’ requests if they are based abroad. Any such transfers shall be performed in accordance with the legal and regulatory provisions in force.

8.6 Your rights

In accordance with the French Data Protection Act of 6 January 1978 (Act 78-17 on Information Technology, Data Files and Civil Liberties), Participants are entitled to access, object to, amend and delete their personal data, by writing to the address below:

Should data be used for the purposes of market research, this shall be performed in accordance with the legal provisions in force.

Participants may have their personal data sent to them in an accessible format. The Organizing Company reserves the right to reject any request that may be deemed unreasonable.

Any Participants exercising their right to remove their personal data before the end of the competition must relinquish their participation in the Competition.

ARTICLE 9: LITERARY AND ARTISTIC PROPERTY RIGHTS

The reproduction, representation or use without prior written authorization of the Organizer of all or part of the components of the contest “Team Total Project Market” (photos, videos, names, logos, trademarks) are strictly prohibited.

As part of its participation in the Contest, Participants are advised that if they are declared winners, they must send to the Organizers photographs illustrating their project. Participation in the Contest implies the sale and Participant copyright of original works to the Organizing Company if a participant is designated a winner. This assignment of rights will be established according to the following terms and confirmed and in compliance with the model appended to this Regulation.

The Participant will transfer to the Organizer the right to reproduce, allow to be reproduced, to represent and adapt the photographs submitted to the Organizing Company in connection with the Contest, the surfaces mentioned below.

The Participant expressly accepts that his/her creations or achievements can be reproduced and/or represented in the following media:

  • Page and account of the Organizer on social networks and sharing sites (such as Facebook, Twitter, Instagram, Youtube, Dailymotion or equivalent);
  • Website www.total-campus.com and other Internet and intranet sites of the TOTAL group;
  • Newsletters owners of the Organizer;
  • Any media present at events from the Organizing Company. This authorization will be given for free for a period of one (1) year from the date the Participant sends photographs to the Organizing Company.

The Participant certifies that they have the authority to consent to this transfer and guarantees the Organizer the reasonable use of photographs, and persons and objects contained therein.

ARTICLE 10: RULES

10.1 Acceptance of the rules

By entering the Competition, Teams and all Team members are unreservedly agreeing to these rules in their entirety.

10.2 Legal deposit

The Competition rules are lodged with: SCP SILINSKI – CHERQUI-ABRAHMI – BLANCHET, Huissiers de Justice associés, 58 avenue Jean Jaurès BP 56, 92140 CLAMART Cedex, etude@huissiers-clamart.com.

The Competitions rules may be sent free-of-charge to anyone requesting them by sending an e-mail to contact@total-campus.info

The rules may also be viewed in their entirety on the Organizing Company’s website at www.total-campus.com by clicking on the ” Competition Terms and Conditions” tab.

They may be viewed, downloaded and printed freely.

The Organizing Company reserves the right to make any amendments to the Rules and/or Website at any time without giving notice or being obliged to justify its decision and without being held liable as a result of this. Any changes to the Rules shall give rise to the Rules being lodged again with: SCP SILINSKI – CHERQUI-ABRAHMI – BLANCHET, Huissiers de Justice associés, 58 avenue Jean Jaurès BP 56, 92140 CLAMART Cedex, etude@huissiers-clamart.com, and shall enter into force with effect from them being posted online and any Team and each of its members shall be deemed to have accepted them merely by entering the Competition with effect from the date on which the change enters into force. Any Team or entrant rejecting the change(s) must cease to take part in the Competition.

10.3 Language of the rules

Only the French version of these rules is valid.

Any version other than the French version is merely a translation for the purposes of convenience.

10.4 Entirety of the rules and invalidity

Should one or more articles of these rules become null and void pursuant to a change in legislation, deregulation or court order, this shall under no circumstances affect the validity and compliance with the other articles of these rules.

ARTICLE 11: LIABILITY

11.1 By entering the Competition, Participants are agreeing to conduct themselves fairly meaning that they must fully observe the rules and the rights of other Participants.

Participants shall refrain from taking part or attempting to take part in the Competition in a way that is not strictly compliant with the stipulations of these rules.

11.2 The Organizing Company reserves the right to reject, deem invalid or invalidate entries from any individuals who do not fully comply with the rules and notably if the information and contact details provided by the Participant are invalid, incorrect or incomplete.

It also reserves the right to preclude entry to the Competition of any individual disrupting the smooth running of the Competition and take legal action against anyone cheating, defrauding, rigging or disrupting the smooth running of the Competition or attempting to do so. Fraud shall entail immediate disqualification of the perpetrator. Any winner who has cheated, attempted to do so or benefited from such acts shall, as of right, be stripped of any entitlement to receive the endowment(s) at stake.

11.3 The Organizing Company reserves the right, at its sole discretion, to perform any check in order to ensure compliance with this article and these rules in their entirety, and notably to disqualify any Participant who has committed wrongdoing of any kind or attempted fraud.

The Organizing Company reserves the right, at any time and without having to explain its reasons, to stop the Competition, extend it, cut it short, change it or cancel it without being held liable as a result.

11.4 The Organizing Company shall under no circumstances be held liable if entries fail to reach it on any grounds that are not attributable to it, notably in the event of web connection difficulties, or if they reach it in a format which is illegible or impossible to process.

Moreover, the Organizing Company shall not be held liable for any direct or indirect damage in connection with the prizes awarded to winners.

ARTICLE 12: COMPLAINTS

Any questions regarding the enforcement or interpretation of these rules must be sent in writing to contact@total-campus.info

ARTICLE 13: APPLICABLE LAW – ASSIGNMENT OF JURISDICTION

These rules are solely subject to French law.

Any disputes arising from the Competition shall be referred to the competent courts.

APPENDIX

Assignation of Rights

  • [Name Surname] (hereinafter the “Participant”) yields to TOTAL SA (hereinafter “the Organizing Company”) the right to reproduce, directly or indirectly, to represent, directly or indirectly and adapt the [number] photographs addressed to the Organizing Company by email on DD/MM/YYYY for the purpose of the Competition, and on the media mentioned below.
  • The Participant expressly accepts that his/her photographs may be reproduced and / or represented in the following media:
  • Page and account of the Organizing Company on social networks and sharing sites (such as Facebook, Twitter, Instagram, Youtube, Dailymotion or equivalent);
  • Website www.total-campus.com and other Internet and intranet sites of the TOTAL group;
  • Newsletters owned by the Organizing Company;
  • All media present at events from the Organizing Company.
  • This authorization is given for free for a period of one (1) year from the date the Participant sends photographs to the Organizing Company.
  • The Participant certifies owning rights to consent to this transfer assignment and warrants the Organizing Company the quiet possession of photographs. The Participants hold the Organizing Company harmless from all evictions, of any kind, that may be brought by third parties in the use of these photographs and the persons featured on the entered photographs.
